France Does Right Thing for Wrong Reason, by Ambassador Mo

France announced (12/26/2011) it will not arrest Florence Hartmann to be sent to The Hague ex-Yugoslav Tribunal, but only because it does not consider her crime as serious under the mandate for the Court. However, the real issue is that this was not a crime at all - in fact the ICTY's (International Criminal Tribunal for the former Yugoslavia) original failure to deliver relevant evidence to its fellow international court, International Court of Justice (ICJ) was the miscarriage of justice in the context of Bosnia & Herzegovina's genocide case against Serbia/Montenegro. Shielding Serbia by failing to deliver such relevant/decisive evidence for the ICJ's review/consideration has allowed Belgrade to avoid accountability and for perhaps millions of victims to be denied recourse. Pitting the fundamental rights of freedom of the press and the Bosnian/Herzegovinian victims of genocide against the dubious ruling of contempt against Hartmann for purportedly revealing details of the decision to keep evidence secret (that would implicate more directly Slobodan Milosevic's Serbia/Montenegro with genocide and grave violations of international humanitarian law) would also bring to greater light such evidence and perhaps motivations/rationale as to why such was kept secret in the first place.Read: - "Reporters Without Borders - Open Letter on Hartmann Case to UN & OSCE" - diplomaticallyincorrect.org/films/blog_post/open-letter-on-hartmann-case-to-un-osce-reporters-without-borders/42939 Florence Hartmann though is not free either. She will have to fear that any travel outside of French jurisdiction may also bring her into another country that might look to execute the ICTY's arrest warrant against her - a real problem for journalist covering global issues. Unfortunately Bosnia & Herzegovina, genocide victims as well as the ICJ continue to be denied access to highly relevant evidence with regards to most the serious violations of international humanitarian law.
