RUSSIA UNEXPECTEDLY INTRODUCES SYRIA RESOLUTION IN UN SECURITY COUNCIL, By, Susan Sacirbey for Ambassador Mo

Late this morning, 15 December, 2011, Russia introduced a resolution in the UNSC on the situation in Syria. Ambassador Muhamed Sacirbey is presently at UN Headquarters in New York garnering more information from his contacts in the UNSC and other diplomats.
According to Ambassador Sacirbey, most diplomats believe that the Resolution is lacking and draws equivalency between the protesters and the Syrian regime.
The timing of the Resolution is perhaps most interesting. Is it meant to preempt action by the Arab League scheduled for week’s end? Is it an indication that Russia is becoming isolated from the Arab world in having previously blocked Security Council action on Syria? Russia’s initiative is the more unusual because it chairs the UNSC for this month, thereby having significant discretion on the agenda of the UNSC this month.
The German, French, and British diplomats were keen to press ahead using the Arab League’s position on Syria for a new UNSC resolution.
The Russian draft and the other delegations in the UNSC were not committed on whether the Syrian matter would be referred to the International Criminal Court (ICC). Rather, there was language regarding a new UNSC mandated commission of inquiry. Ambassador Sacirbey believes that this could deflect and defer from the ICC’s role, and that a new commission of inquiry serves no purpose except to delay and potentially deflect as UN Human Rights Chief Navi Pillay has already undertaken an OHCHR investigation, and only the ICC investigation and potential indictments remain as the next plausible steps.
Action on the Resolution will begin with consultation behind closed doors at the “expert level” tomorrow, we have been told informally. Any vote and adoption on the resolution could not happen before this weekend. Ambassador Muhamed Sacirbey surmises that the differences and underlying motives are too significant for quick action. However, the Secretary-General of the Arab League, Nabil el-Araby, having represented Egypt at the United Nations will also have a good sense of how to shape the UNSC potential resolution on Syria, rather than the other way around.
