“Recent decisions taken by Republika Srpska authorities represent the most serious violations of the Peace Agreement since it was signed more than 15 years ago” High Representative Dr. Valentin Inzko for Bosnia & Hercegovina (HR for BiH) states in his letter to the UN Security Council (UNSC). He requests the UN Security Council to undertake urgent action to confront Republika Srpska’s (RS) leadership in efforts to threaten Bosnia & Herzegovina’s (BiH’s) sovereignty and territorial integrity as well as functionality. The challenges by RS authorities to the High Representative’s authority and previous measures enacted in support of the Peace Agreement are cited as contravening Resolution 1031 enacted under Chapter VII of the UN Charter, (which has been employed to authorize” all necessary measures” to confront “threats to international peace and security” including in BiH. VIOLATIONS of PEACE AGREEMENT, INTERNATIONAL COURT RULINGS (ICJ & ICTY) & UN SECURITY COUNCIL RESOLUTIONS The supplemental and urgent letter forwarded by Dr. Inzko on May 4th to the UNSC and Secretary General Ban Ki-moon cites a long list of violations of the Peace Agreement and threats to BiH by the RS leadership including: • Referendum effectively allowing the RS to ignore BiH Constitutional and State Courts and Laws as well as previous decisions of the HR for BiH on that part of BiH within the boundaries of the RS. • “The authorities of Republika Srpska have also pursued a policy of obstructing, undermining and questioning the authority of other state level institutions…” • RS authorities have continued to undermine the Constitution of BiH adopted under the Peace Agreement. • RS authorities are seeking to undermine and reverse work and previous decisions of the HR for BiH, who is final arbitrar for implementation of the Peace Agreement, and whose authority is vested under Chapter VII of the Charter by the UNSC. • “They (RS authorities) have continued to deny the genocide that took place in Srebrenica in 1995 (ruled by ICJ and ICTY).” RS PRESIDENT MILORAD DODIK PARTICULARLY FAULTED FOR THREATENING TERRITORIAL INTEGRITY & SOVEREIGNTY OF BiH The HR for BiH particularly singles out RS President Milorad Dodik for such violations and obstruction: “these decisions must be seen in the broader context of other developments reported in my regular b-annual report to the Secretary General. Specifically the authorities of Republika Srpska and in particular its President (Milorad Dodik) have continued to question the territorial integrity and sovereignty of Bosnia & Herzegovina, repeatedly questioning the sustainability of the country and advocating its dissolution” MAY 9 SHOWDOWN at UN SECURITY COUNCIL Dr. Inzko, I believe, understands that this is a defining moment. No need for hyperbole, but this may be the future of BiH as well as peace. Dr. Inzko clearly alerts the Security Council and its key members, (he will in Washington over the weekend): “if the current situation is not checked there exists a real danger of future attempts to divide the country and its people which could have significant political and security implications for the broader region.” We will see if there is a will. The message is abundantly clear.
