We Are Uncertain – But Some Crime Must Have Occurred, Sexual Assault or False Accusation. NY Times will report that two law enforcement sources are indicating problems with the alleged sexual assault victim’s story and/or her credibility. Perhaps only coincidence that this “new information” comes out less than 24 hours before DSK returns to Court for another bail hearing. The purported problems with the victim’s story have not been fully identified, but are also now thrown into the arena of speculation fed by leaks not consistent with responsible law enforcement work. She may have not been truthful on her US asylum application. She may also have had links to some involved in criminal activity. Of course, this has no direct relevance as to whether she was sexually assaulted or not. It may impact on the perception of her credibility. However, this could also reflect upon a motive to reveal now such purported problems with her credibility. There is also another story of $100,000 being deposited into alleged victim's account. There is good reason to ask regarding the source and reason for such payment, but again it is not dispositive of whether sexual assault did or did not occur over a month earlier at the Sofitel Hotel in NYC. Sexual Act Did Take Place that Now Justice Demands to be Explained? The police and prosecution from the outset claimed to have “DNA evidence.” They alleged that at least one sexual act did occur – oral sex. That would have to fall into the category of either consensual or, in the alternative, forced sex. Thus, putting aside all other considerations, the existence of DNA evidence needs to be explained: consensual, prostitution or set-up (conspiracy). Why would this young woman who is around male hotel guests all the time be so aroused as to engage in sex with DSK without any other inducement? If DSK paid for the sex, why would then the presumed prostitute report such to the police, claiming rape, especially as this could endanger her in many ways, including her status in the US? If it was a set-up, then a crime also has been committed and should be investigated for its political and judicial ramifications. One Certainty Now – A Crime Did Occur: It appears relatively clear now though that either DSK or the alleged sexual assault victim has committed a crime and the other may have been wronged. It is no longer possible to assume a simple misunderstanding. Law enforcement/prosecutors also though must be questioned as to their role. If DSK was really part of consensual sex or set-up, then law enforcement directly contributed to the destruction of his career at the IMF and real opportunity as candidate for the French Presidency. On the other hand, if the apparent sexual assault victim is truly a victim, then law enforcement appears to be also the source now for the destruction of her character currently under way through the same media that has already savaged DSK. Maybe “law enforcement” is the one that needs to look in the mirror here? Was there too much enthusiasm to preempt the legal process, and have DSK convicted in the media and court of public opinion, starting with the “perp walk” to the leaking of alleged evidence against DSK? Or, is the same law enforcement ready to throw the alleged sexual assault victim under the bus now because she may be proving a less sympathetic witness? “Law enforcement” may have a tendency to see this more in the context of their own careers and ego. It would not be the first time that facts may be embellished or worse. More than Ever, Truth & Accountability Demanded Under any of the possibilities evident now a crime did occur. DSK did sexually assault, or the alleged victim filed a false police report/accusation. Further, was there a set-up of DSK then (with much broader political implications), or is the alleged victim being smeared now? How has action of “law enforcement” contributed to the distortion(s) and consequences? Now, the public in at least two countries and justice more than ever demand the truth and accountability.
